Terms of Service

Notice: These Terms have not yet been reviewed by licensed counsel. The Friday Pack intends to engage IP/SaaS counsel to finalize this document prior to any disputed enforcement. Use is at your own risk pending that review.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of The Friday Pack ("The Friday Pack," "we," "us," or "our"), a market-research and lead-research data product for short-term rental ("STR") operators. By creating an account, placing an order, or paying for any pack or subscription, you agree to be bound by these Terms. If you do not agree, do not use the service.

2. Description of Service

The Friday Pack produces curated, ranked lists of residential rental listings ("Lead Packs") in US markets selected by you. Each Lead Pack contains property listings the operator believes meet criteria favorable to STR arbitrage or master-leasing strategies, along with publicly-available owner contact information, observable signals, and suggested outreach openers. Lead Packs are delivered as CSV files and interactive HTML trackers via email or your account dashboard within the timeframes specified in our Service Level Agreement.

Lead Packs are research products for the personal business use of the purchasing operator. The Friday Pack does not provide financial advice, legal advice, tax advice, real estate brokerage services, investment advisory services, property management services, or skip-tracing services subject to the Fair Credit Reporting Act ("FCRA"). Owner contact data included in Lead Packs is aggregated from publicly available sources for the purpose of business-to-business outreach about long-term residential leases. You may not use Lead Pack data for any purpose covered by the FCRA (including but not limited to credit decisions, employment screening, or insurance underwriting). You are solely responsible for ensuring your outreach complies with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, applicable state mini-TCPA laws, the National Do Not Call Registry, and any other applicable laws.

3. No Guarantee of Outcomes

STR arbitrage and master-leasing involve substantial financial risk, including the risk of total loss. Outreach to landlords may yield zero leases, partial leases, or unfavorable terms. The Friday Pack makes no representation, warranty, or guarantee — express or implied — regarding any business outcome you may experience after using a Lead Pack, including without limitation: response rate to your calls or messages, willingness of any landlord to lease or sublease to you, accuracy of any specific lead's contact information at the moment of your outreach, future rental performance of any leased property, or any specific revenue, occupancy, or profit figure. Past performance of similar leads does not predict future results.

4. Your Account and Eligibility

You must be at least 18 years old and legally capable of entering binding contracts to use The Friday Pack. You agree to provide accurate registration information (including a valid email address and market selection) and to keep it current. You are responsible for safeguarding your account credentials and for all activity occurring under your account. Notify us immediately at support@thefridaypack.com of any unauthorized access.

5. Lead Pack Content and Permitted Use

The Lead Packs we deliver contain:

(a) Property addresses publicly displayed on third-party listing platforms; (b) Owner names and contact information aggregated from publicly accessible records (county property records, public business filings, owner-published listings); (c) Property characteristics (rent, beds, baths, listing date, zoning class); (d) Our analyst's good-faith composite ranking and outreach suggestions.

You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to use the Lead Pack solely for your own business outreach to the listed owners regarding long-term lease arrangements. You may share the Lead Pack with your immediate team, agent, attorney, or accountant for the purpose of evaluating or executing on the deals it contains. You may NOT:

  • Resell, redistribute, sublicense, or republish any Lead Pack or its contents in whole or substantial part;
  • Use Lead Pack data for any purpose subject to the FCRA;
  • Use Lead Pack data for telemarketing prohibited by the TCPA, CAN-SPAM, or any state mini-TCPA law;
  • Use Lead Pack data to send unsolicited SMS messages, robocalls, or pre-recorded messages without prior express written consent of the recipient;
  • Resell or transfer your account access to any third party;
  • Use any automated system (bot, scraper, crawler) to access, query, or extract content from The Friday Pack website, dashboard, or APIs;
  • Attempt to reverse-engineer our scraping infrastructure, ranking methodology, or underlying datasets;
  • Submit fraudulent, misleading, or fabricated information when ordering a Lead Pack.

6. Compliance With Outreach Laws

You acknowledge that telephone outreach in the United States is regulated by federal law (TCPA, CAN-SPAM, FCC regulations), state law (state mini-TCPA laws, "do not call" lists), and platform terms of service (where applicable). You agree that you, not The Friday Pack, are solely responsible for compliance with all such laws and policies in connection with your use of Lead Pack data. The Friday Pack provides Lead Pack data on the condition that you use it lawfully; we make no warranty that any particular outreach method is compliant with any particular law in any particular jurisdiction.

7. Indemnification

You agree to defend, indemnify, and hold harmless The Friday Pack, its founders, employees, contractors, affiliates, and agents from and against any and all claims, demands, damages, losses, liabilities, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

(a) Your outreach to any individual or business listed in a Lead Pack, including alleged violations of the TCPA, CAN-SPAM, FCRA, state mini-TCPA laws, "do not call" rules, or any other federal, state, or local law; (b) Your breach of these Terms; (c) Your violation of any third-party right (including privacy, publicity, or intellectual property rights); (d) Any business decision you make in reliance on a Lead Pack; or (e) Your use or misuse of any Lead Pack.

8. Fees, Payment, Refunds, and Subscriptions

Pricing is displayed at checkout and may change from time to time. Payment is processed by our third-party payment processor, Stripe, Inc. You authorize Stripe to charge your designated payment method for all applicable fees.

For one-time Starter Packs: payment is charged at order placement; refunds are governed by the Refund Policy.

For Weekly and Pro subscriptions: payment is charged monthly in advance; you authorize automatic recurring billing until you cancel. You may cancel any time from the Stripe Customer Portal, accessible via the link in your order confirmation email. Upon cancellation, you will receive all Lead Packs paid for through the end of your then-current billing period and no further charges will occur. We do not pro-rate refunds for partial periods.

Our Refund Policy (/legal/refunds) is incorporated by reference into these Terms.

9. Intellectual Property

The Friday Pack and its licensors own all right, title, and interest in and to the service, including the Lead Pack templates, scoring methodology, ranking model, software, website, branding, and all derivative works thereof. Nothing in these Terms transfers any intellectual property rights to you other than the limited license to use Lead Packs you purchased as described in Section 5.

10. Disclaimer of Warranties

THE SERVICE AND ALL LEAD PACKS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR COMPLETENESS OF ANY OWNER CONTACT INFORMATION. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY OWNER PHONE NUMBER IS CURRENTLY REACHABLE, THAT ANY LISTED PROPERTY IS STILL AVAILABLE FOR LEASE, OR THAT ANY OWNER WILL RESPOND TO OUTREACH.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FRIDAY PACK'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO THE FRIDAY PACK IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). IN NO EVENT SHALL THE FRIDAY PACK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST INVESTMENTS, LOST DATA, TCPA STATUTORY DAMAGES YOU MAY INCUR FROM YOUR OWN OUTREACH, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Account Termination and Data Deletion

You may terminate your account at any time by emailing support@thefridaypack.com or canceling your subscription via the Stripe Customer Portal. Upon termination, we will delete your account credentials and personally identifiable information within thirty (30) days, subject to retention required for legal, tax, accounting, or fraud-prevention purposes. Lead Packs already delivered to you remain in your possession; we retain a copy of delivered packs for dispute-resolution purposes only.

We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for conduct we reasonably believe to be harmful to The Friday Pack, our users, or third parties — including, without limitation, any pattern of TCPA/CAN-SPAM/FCRA violations in your use of Lead Pack data.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. (Founder note: Florida is the placeholder default based on operator's primary nexus; please confirm with counsel based on the entity of record before disputed enforcement.)

14. Mandatory Arbitration and Class Action Waiver

Please read this section carefully — it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or the service ("Dispute") shall be resolved exclusively by final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in English, with a single arbitrator, in Tampa, Florida (or remotely by mutual agreement). Judgment on the award may be entered in any court of competent jurisdiction.

You and The Friday Pack each waive the right to a trial by jury and the right to participate in a class action, collective action, or representative proceeding. Disputes must be brought in your individual capacity only. If this class-action waiver is found unenforceable, the entire arbitration provision shall be void, and Disputes shall be resolved in the state or federal courts of Florida.

You may opt out of this arbitration provision by emailing support@thefridaypack.com within thirty (30) days of first accepting these Terms, with the subject line "Arbitration Opt-Out" and your account email in the body.

Notwithstanding the foregoing, either party may bring an individual action in small-claims court for qualifying disputes, and either party may seek injunctive relief in court for intellectual property infringement.

15. Changes to These Terms

We may modify these Terms from time to time. Material changes will be communicated by email and by updating the "Last Updated" date above. Continued use of the service after changes take effect constitutes acceptance.

16. Miscellaneous

These Terms, together with the Privacy Policy, Refund Policy, and SLA, constitute the entire agreement between you and The Friday Pack. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
